When did maintaining sliding doors become Strata’s responsibility?
The simple answer is that for any building built before the introduction of the Freehold Development Act 1973, all sliding door repairs are the responsibility of the title holders and not the strata.
The Freehold Development Act 1973 (Strata Schemes) commenced on 1 July 1974 and replaced the previous legislation, Strata Titles Act 1961 (Conveyancing).
The Strata Titles Act 1961 provided that the centreline of the dividing structures—walls, floors, or ceilings—was the boundary between separate lots or between lots and common property.
The Freehold Development Act 1973, commencing on 1 July 1974 provided the relocation of some boundaries from the centreline of a structure (e.g., wall, floor, or ceiling) to the face of the structure. The structure then became common property.
Who is responsible for sliding doors in buildings built pre-1973?
Where these provisions created an issue is the wall within a lot of the living area and the balcony.
For any building built before 1973, the balcony, doors, and windows will remain part of the lot and not become common property. Therefore, title holders are responsible for the repairs to the glass sliding door on the balcony.
In these instances, even though the balcony sliding doors are the responsibility of titleholders, they still need to apply to Strata to replace them. This is so the strata can keep the façade of the building in concert with the rest of the units.
